Terms and Conditions

To avoid any misunderstandings here are our pupils’ terms and conditions. We have tried to make them as easy to read as possible for you.

Drive RJM is the trading name for Drive RJM Ltd. and shall be referred to throughout these terms as Drive RJM. The company number for Drive RJM Ltd is 16348867.

By becoming a pupil of Drive RJM you agree to become bound by the following conditions:

FEES AND CANCELLATION

All driving lessons are subject to a minimum 2 working days (48 hours) notice of cancellation. If the above notice is not given, the instructor retains the right to charge the full tuition fee. Cancellation should be made by WhatsApp or text message to 07539 283257 or by email to rowan@driverjm.co.uk. Contact must be made using the telephone number or email address we have on file. Before the start of your first lesson, it is your responsibility to present your valid UK provisional driving license. Failure to do so entitles the instructor to cancel any lessons until you can present it, and you may be charged. Any lesson that is cancelled, postponed, or rescheduled by Drive RJM due to mechanical breakdown or other emergencies such as illness or bereavement will not be charged. We will endeavour to find a replacement vehicle or instructor as soon as possible, but this is not guaranteed. Drive RJM will not be liable for any test fees, other expenses incurred, or compensation in the event of short notice cancellation by Drive RJM.

INTENSIVE COURSES

Full payment is required upon booking and no diary time will be allocated until payment is received. Intensive courses can be rescheduled without penalty up to 14 days before the course is due to commence, if you wish to reschedule within 14 days of the start day of the course we withhold the right to charge part or all of the course at our sole discretion. Any parts of the course missed without adequate notice are non-refundable, but we may agree to re-schedule part or all of those lessons at our discretion.If you wish to cancel entirely we will refund 50% of the cost of the course providing you request a refund within 30 days of booking/invoice and no less than 14 days before the course is due to start.

APPOINTMENTS

The instructor will do their best to ensure pupils receive tuition at the agreed times. All bookings are made under the understanding that Drive RJM is not responsible for any postponements due to traffic conditions, adverse weather, mechanical breakdowns of equipment, or any other unforeseen circumstances beyond their control.

DISCOUNTS/SPECIAL OFFERS

Offers cannot be used in conjunction with another offer. If more than one promotional offer is running at the same time the student will have to choose which offer suits their requirements best. Any introductory rates are only available on the first booking the pupil makes with Drive RJM. Block booking discounts are available throughout the duration of training with Drive RJM. To be eligible for a block booking discount payment for the full block is required up front before the first lesson within the ‘block’

PAYMENTS

Payments can be made by either Cash or Bank transfer. Payments by bank transfer must be made a minimum of 48 hours before the lesson start to secure your booking. If payment has not been made within 48 hours of your lesson start time we may reschedule or cancel your lesson at our discretion. If you wish to pay by cash for your lessons you should have the fee for your first and second lesson ready to pay at the beginning of your first lesson. Payment for each subsequent lesson is then taken at the end of each lesson.

PRICING

Our prices are subject to change at any time for new purchases. We will notify you at the point of booking/purchase if our prices have changed. If a block purchase has been made before the price change, the lessons covered by that block will remain at the old price, with any subsequent lessons or block purchases at new prices.

THE DRIVING TEST

Your driving instructor is entitled to withdraw their car for your test if they feel you’re not ready. We’ll always give you at least 14 working days’ notice, unless you come to us at short notice (less than 14 working days). The DVSA, which conducts learner driving tests, requires 10 working days’ notice to avoid losing your test fee. You can still take your driving test in our car if you don’t pass a mock driving test, as long as your instructor is confident you still have a fair chance of passing. Instructors can sometimes become ill at short notice. We’ll do our best to find you another instructor, but we can’t guarantee anything at such short notice. If your instructor’s car isn’t roadworthy for your test, they’ll do their best to find you a similar vehicle. However, we can’t guarantee an identical one. If the DVSA examiner declines to take your test in your instructor’s car because it’s not roadworthy for any reason, like a nail in the tyre or a brake light not working, your instructor will pay for a replacement test. But we can’t be held responsible for any failure of light bulbs or other issues during the practical test. If you damage the car during the driving test, and the total repair cost is less than your instructor’s insurance excess, you’ll be responsible for the damages. Please note that we have a set test day rate that includes a 1-hour lesson before the test, the use of the car for the test, and debrief time afterwards. We’ll discuss this with you when you book your test. If your instructor books a practical test on your behalf and doesn’t receive payment, they can cancel the test at any time. Make sure the instructor is available before booking your driving test. It’s your responsibility to bring all the necessary paperwork for the test.

PERSONAL PROPERTY

The instructor accepts no liability for personal property left in any training vehicle.

REFUNDS

You are entitled to a refund for a payment made for driving instruction if you change your mind. You must request this in writing to rowan@driverjm.co.uk or post to our registered address and it must be within 30 days of invoice and no less than 48 hours before commencement of a lesson that the refund applies to. We do not offer partial refunds for remaining hours of a pre-paid block booking, however credit can be used towards payment for other services with Drive RJM such as confidence boosting lessons, motorway driving lessons, pass plus etc. or transferred to a friend or family member. This must be completed within the timeframe outlined below. If purchasing a single lesson this must be taken within 3 months of purchase, for block bookings the first lesson must be within 3 months of purchase and all lessons taken within 12 months of purchase. After this time the credit has expired. If Drive RJM are no longer able or willing to provide lessons to you, for whatever reason at our sole discretion, we will refund any credit you have with us by the same method it was received within 14 days.

PERSONAL INFORMATION

All personal information provided to Drive RJM is used to deliver the intended service and strictly confidential records are kept. Occasionally, your information may need to be shared with third parties to provide a requested service, and your permission will be obtained before this happens.

LIMITATION OF LIABILITY

Drive RJM is not liable to you (the pupil) for any loss or damage caused in connection with any business interests, including lost profits, earnings, opportunities, businesses, or interruptions. This includes any negligence or breach of statutory duty. The content provided on this website, including information, logos, and images about Drive RJM and its services, is displayed without any warranty, implied or otherwise. This includes warranties of satisfactory quality, fitness for a particular purpose, compatibility, non-infringement, accuracy, and security. Drive RJM does not represent the information as error-free and is not liable for any viruses or malware transmitted between devices or users.

MECHANICAL FAULTS WITH THE CAR OR DAMAGE CAUSED

If the teaching vehicle experiences a mechanical fault during the lesson that cannot be prevented, we will extend the remaining time to your next lesson. However, if this is not feasible, we will offer a refund for the remaining minutes owed. In the event that the car is damaged due to driver error from the pupil, any time spent resolving the issue will be considered as the pupil’s lesson time. For instance, if the pupil hits the kerb on a road and damages the alloy or punctures a tyre, the pupil will lose any remaining time spent changing the tyre. The instructor will not charge the pupil for the damages; only the lesson time will be lost.
